On December 25, 2015, Circuit Court Judge Justin C. Angel granted Adam Braseel’s petition for relief, vacating his conviction. Adam was released on bond in January of 2016, and began preparing for a new trial.
The State then appealed Judge Angel’s decision to the Tennessee Court of Appeals. On October 7, 2016, the appellate court reversed the Circuit Court ruling, which meant that Adam’s conviction was immediately reinstated. His bond was revoked and he was ordered back to prison.
Adam filed an application to appeal the appellate court decision to the Tennessee Supreme Court on October 11, 2016. His request for a hearing was denied by the high court last month.
Adam’s next step is to file a federal habeas petition. There is a deadline to file this petition, so the clock is currently ticking. Adam is in need of funds to pay for an attorney to file his petition. Adam’s family is hopeful that an attorney will come forward to offer their services pro-bono. In the meantime, they continue to work to raise money to hire an attorney on their fundedjustice page.
